Welcome to CanadaSecure (canadasecure.ca). These Terms of Service (“Terms”) govern your access and use of our website, automated security scanners, and professional diagnostic assessment services. By accessing our site, booking an assessment, or utilizing our trust-page guidance, you agree to be bound by these Terms.
1. Scope of Cybersecurity Assessment Services
CanadaSecure provides fixed-scope cybersecurity baseline reviews, Microsoft 365 configuration audits, credential exposure scans, and website vulnerability diagnostics. These services are subject to the following technical and operational limits:
- Snapshot in Time: Our assessments represent a snapshot of your digital infrastructure at the exact moment of the audit. Vulnerabilities, configurations, and threats evolve rapidly.
- Non-Intrusive Scanning: Our scans are non-destructive and non-intrusive. We do not perform active penetration testing or invasive attacks that could degrade network availability.
- No Guarantee of Immunity: Our reviews are designed to identify known security gaps and establish compliance baselines. They do not constitute an absolute guarantee against breaches, ransomware, user errors, or advanced targeted compromises.
2. Trust-Page Guidance and Public Claims
Qualifying businesses may receive guidance on establishing a dedicated security trust-page to communicate their posture to third parties. CanadaSecure does not certify, warrant, or guarantee any business's security, compliance, or absolute operational safety. Any public security claims are the sole responsibility of the business. CanadaSecure reserves the right to request the removal or correction of any public statements that misrepresent the scope, timing, or results of our security assessments.
3. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, IN NO EVENT SHALL CANADASECURE, ITS PARTNERS, OR ITS EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES—INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE, DATA LOSS, CYBERSECURITY BREACHES, DATA COMPROMISES, OR BUSINESS INTERRUPTION—ARISING OUT OF THE USE OF OUR ASSESSMENTS, DELIVERABLES, REVIEWS, OR REMEDIATION RECOMMENDATIONS. SMALL BUSINESSES ARE STRONGLY EXPECTED TO MAINTAIN COMPREHENSIVE CYBER INSURANCE AND ACTIVE DATA BACKUPS SEPARATE FROM OUR AUDIT PROCESSES.
4. Payment and Refund Terms
All productized assessment fees (Essentials, Professional, Enterprise) are billed prior to the delivery of the diagnostic Risk Report. Once our engineers have completed the diagnostic reviews and delivered the canonical assessment findings, all payments are considered final and non-refundable, as the specialized consulting hours and analytical reports have been fully rendered.
5. Governing Law and Jurisdiction
These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal action, suit, or proceeding arising out of these Terms or our services shall be brought exclusively in the courts located in Toronto, Ontario.
6. Amendments
We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated “Last Updated” timestamp. Your continued use of our website or services following any such modifications constitutes your acceptance of the updated Terms.
